Basis for collecting, processing and storing your personal data

Art. 1. (1) Platinum Life Ltd. collects and processes your personal data in connection with the provision of marketing services, travel services, training and consulting and the conclusion of contracts with the company on the basis of Art. 1, Regulation (EU) 2016/679, and in particular on the basis of the following:

  • Your explicit consent to the processing of your personal data for one or more specific purposes;
  • Performance of Platinum Life Ltd’s obligations under its contract with you;
  • Compliance with a legal obligation that applies to Platinum Life Ltd;
  • For the purposes of the legitimate interest of Platinum Life Ltd.

(2) Platinum Life Ltd. is the data controller with respect to your data as a user of our services.

(3) The personal data that Platinum Life Ltd. collects, processes and stores in order to fulfill its contractual relationship with you are:

  1. first and last name
  2. date of birth and/or Unique National Identity Number (UIN) – in cases where this is necessary for us to fulfil our contractual relationship or if we are obliged to do so by law
  3. e-mail address
  4. Passport/ID card number
  5. a cookie identification number, which are necessary for the proper functioning of the website system, allowing us to maintain a logical session between your client browser ( profile) and the server

Purposes and principles for the collection, processing and storage of your personal data

Art. 2. (1) Platinum Life Ltd. collects and processes the personal data you provide to us in connection with the use of our marketing services and for entering into a contract with the company, as well as for enrolling in our services, including for the following purposes:

  • individualization of a party to the contract;
  • information security protection;
  • securing the performance of the contract for the provision of the relevant service;
  • accounting purposes;
  • statistical purposes;
  • sending information messages about marketing services, events, consultations;
  • improve and personalize the Service by offering you relevant offers, articles, events and other products and services that may be of interest to you;

(2) Platinum Life Ltd. adheres to the following principles when processing your personal data:

  • integrity and confidentiality of processing and ensuring an appropriate level of security of personal data;
  • legality, fairness and transparency;
  • limitation of the purposes of processing;
  • relevance to the purposes of the processing and minimisation of the data collected;
  • limitation of storage to achieve the objectives;

Storage period of your personal data

Art. 3. Your personal data shall be stored by the controller until your consent to processing is withdrawn by reference to the cancellation of the subscription at the end of the e-newsletter or by written application, in which case Platinum Life Ltd. shall cease processing your personal data.

Withdrawal of consent to the processing of your personal data

Art. 4. If you do not wish your personal data to continue to be processed by Platinum Life Ltd. for any or all of the processing purposes, you may withdraw your consent to processing at any time by following the unsubscribe link at the end of the e-newsletter or by writing to application to Platinum Life Ltd.

Right to erasure (“being forgotten”)

Art. 5. You have the right to request from Platinum Life Ltd. the deletion of the personal data relating to you, and Platinum Life Ltd. has the obligation to delete them without undue delay when one of the following grounds applies:

  • the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
  • if you withdraw your consent on which the processing is based and there is no other legal basis for the processing;
  • if you object to the processing of personal data relating to you, including for marketing purposes, and there are no legitimate grounds for the processing that override;
  • personal data have been unlawfully processed.

(1) To exercise your right to “forget”, you should submit a request to Platinum Life Ltd.

(2) Platinum Life Ltd. does not delete data that it has a legal obligation to store, including for the defense of legal claims made against it or to prove its rights.

Art. 6. Platinum Life Ltd. stores your personal data for the following periods

(1) Under Article 91 of the Law on Tourism 2 years (plus 6 months for the movement of a legal file “without movement”, after the date of expiry of the above period)

(2) Until the expiration of the general five-year limitation period in contractual relations, (e.g. Article 111 of the Law on Obligations in conjunction with Sections 60-68 of the DPL to the Law on Tourism) (with the possibility of extension up to 6 months for the movement of a legal file “without movement”, after the expiration date of the above-mentioned period)

(3) Under the Accounting Act – 10 years, and/or until the completion of the audit and/or the counter audit by the NRA (if the audit is not completed before the expiry of the 10 years).

(4) In the case of employment and insurance relations – 50 (fifty) years

(5) In court proceedings until 5 years after the case has been filed with the court. (with a view to the recovery of costs) In the case of related proceedings (for example, where one is preliminary to the other, the time limit expires for both proceedings at the end of the fifth year in respect of the latter).

(6) Upon expiry of the period within which claims may be asserted under the contract

Your rights in the event of a personal data breach

Art. 7. (1) If Platinum Life Ltd. identifies a breach of security of your personal data that may pose a high risk to your rights and freedoms, we will notify you without undue delay of the breach, as well as the measures that have been taken or are to be taken.

(2) Platinum Life Ltd is not obliged to notify you if:

  • has taken appropriate technical and organisational measures to protect the data affected by the security breach;
  • has subsequently taken measures to ensure that the infringement will not result in a high risk to your rights;
  • notification would require a disproportionate effort.
